Elita La Vie provides coaching, online courses, digital resources, educational content, workshops and personal development programmes designed to support wellbeing, behaviour change and personal growth.

All content published or made available through the Elita La Vie website and services is the intellectual property of Charlene Gibberd, trading as Elita La Vie, unless otherwise stated. This includes, but is not limited to:

Images, graphics and branding
Logos, trademarks and designs

Any other material created as part of the Elita La Vie services
Your purchase grants you a personal, non-transferable, non-exclusive licence to access and use the materials for your own individual learning and personal development only.
Nothing in these Terms transfers ownership of any intellectual property rights to you. All rights not expressly granted remain reserved by Elita La Vie.
You must not copy, reproduce, distribute, publish, modify, sell, licence, share, upload or otherwise make any part of our content available to another person or organisation without our prior written permission.
Access to digital courses, memberships, coaching resources and any accompanying materials is for the registered purchaser only. Login details must not be shared with others, and access may not be transferred, resold or used by multiple people.
You may download or print resources where this functionality is provided, provided they are used solely for your own personal use and are not reproduced, distributed or used for commercial purposes.
We welcome you sharing and recommending Elita La Vie. If you wish to quote, reproduce or share any of our content publicly, please obtain written permission in advance and provide clear attribution to Elita La Vie, including a link to www.elitalavie.com where appropriate.
Any unauthorised use of our intellectual property may result in the suspension or termination of access to our services and may lead to legal action where appropriate.
User Accounts
Users are responsible for maintaining the confidentiality of their login details.

Share, reproduce, distribute, record, sell or otherwise make available any course materials, coaching resources, recordings or other intellectual property without prior written permission.
Share your account, membership or login details with another person or allow others to access services purchased under your account.
Copy, reproduce or use any Elita La Vie content to create, deliver or sell your own coaching, training, courses or other commercial products without prior written permission.
Attempt to gain unauthorised access to any part of the Website, Services, user accounts or computer systems.
Introduce viruses, malware or other harmful technology, or otherwise interfere with the security or operation of the Website or Services.
Attempt to bypass, manipulate or interfere with payment systems, pricing, subscriptions or security measures.
Use the Website or Services for any unlawful, fraudulent or unauthorised purpose.
We reserve the right to investigate any suspected breach of these Terms and Conditions.
Where we reasonably believe that a user has breached these Terms, we may, at our sole discretion:
Suspend or terminate access to the Website, Services or any digital content.
Remove access to memberships, online courses or coaching programmes without refund where appropriate.
Cancel future bookings or purchases.
Take any other action reasonably necessary to protect our intellectual property, business, clients and community.
Take legal action where appropriate.
Any exercise of these rights will not affect any other legal remedies available to us.
Sale of Services
These Terms and Conditions govern the sale of services available on and within our website & services.
We are under a legal duty to provide services and digital content that conform to the contract.

The services will be paid for in full when the services are ordered, unless otherwise arranged in writing.
These Terms and Conditions apply to all the services that are displayed on our website at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our website at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Prices may change at any time but changes will not affect purchases already made.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Where payment plans are offered (Klarna), all installments remain payable according to the agreed schedule.
Refunds, Cancellations and Cooling-Off Rights
We want you to feel confident when purchasing from Elita La Vie. The following explains your cancellation and refund rights alongside your statutory rights under applicable consumer protection law.
Nothing in this policy affects your legal rights.
Your 14-Day Cooling-Off Right
If you are purchasing as a consumer, you generally have the right to cancel your purchase within 14 days of entering into the contract without giving a reason.
However, this right may end earlier where you have requested immediate access to digital content or asked us to begin providing coaching or other services during the 14-day cancellation period, in accordance with applicable consumer law.
Cancelling a Purchase
If you wish to cancel a purchase or discuss a refund, please contact us within 14 days of purchase by emailing charlene@elitalavie.com.
Where a refund is due, it will normally be made using the original payment method within 14 days of the refund being approved or as otherwise required by applicable consumer law.
Online Courses and Digital Content
This includes, but is not limited to:
The Elita La Vie Approach in all formats
Short online courses
Educational programmes
Digital workbooks, templates and downloadable resources
Video and audio content
Other digital content made available through our Website
Access to digital content is normally provided immediately upon successful purchase.
Refunds for digital content will not normally be available once access has been granted, except where required by applicable consumer protection law.
Individual (1:1) Coaching
If you purchase a coaching package and coaching has not yet begun, you may cancel in accordance with your statutory rights.
If you request that coaching begins during the 14-day cooling-off period and later choose to cancel, we reserve the right to charge for any coaching sessions or services already provided before your cancellation.
Once coaching has commenced, refunds for completed coaching sessions are not available.
Coaching packages are valid for six (6) months from the date of purchase unless otherwise agreed in writing. Any sessions not used within this period will expire and are non-refundable.
Group Coaching Programmes
Group coaching programmes combine live coaching sessions with supporting resources and, where applicable, session recordings.
If you purchase a group coaching programme, your statutory cancellation rights will apply in accordance with applicable consumer protection law.
Once a group coaching programme has started, refunds are not normally available except where required by law.
To ensure the best possible experience for all participants, we encourage attendance at all live sessions wherever possible. If you are unable to attend a live session, recordings will be made available where this forms part of the programme. Missed live sessions are not eligible for refunds, transfers or replacement sessions.
Group coaching is built upon mutual respect, professionalism and confidentiality. By participating, you agree to treat all participants with courtesy and respect and to keep confidential any personal information shared by others during the programme.
Any behaviour that is abusive, threatening, discriminatory, disruptive, or that repeatedly interferes with the learning experience of others may result in your removal from the programme without refund, where appropriate.
Whilst Elita La Vie will treat information shared within the programme confidentially, we cannot guarantee that other participants will always do so. Participants are therefore encouraged to use their own judgement when sharing personal information within a group setting.
Coaching services
Elita La Vie provides coaching to support personal development, behaviour change, wellbeing and the achievement of personal or professional goals.
Coaching is a collaborative process designed to help you identify goals, explore challenges and take meaningful action. Coaching is not therapy, counselling, psychotherapy, medical treatment, legal advice or financial advice, and should not be considered a substitute for support from an appropriately qualified professional where this is required.
Whilst every effort is made to provide a high-quality coaching experience, we cannot guarantee any particular outcome or result. Your progress will depend on many factors, including your commitment, participation and the actions you choose to take outside of coaching sessions.
By purchasing coaching services, you acknowledge that you remain responsible for your own decisions, actions and wellbeing throughout the coaching process.
If you have concerns about your physical or mental health, or believe you require medical, psychological or other specialist support, you should seek advice from an appropriately qualified professional.
Session Bookings, Cancellations and Rescheduling
Individual coaching sessions can be booked through the Elita La Vie website using our online booking system.
If you need to cancel or reschedule a coaching session, please do so as soon as possible.
Where at least 4 hours' notice is provided, sessions may be rescheduled using the online booking system, subject to availability.
Cancellations or requests to reschedule made within 4 hours of the scheduled start time will normally result in the session being forfeited and cannot be rearranged or refunded.
We understand that unexpected circumstances can arise. At our sole discretion, we may choose to reschedule a session cancelled at short notice in exceptional circumstances. Any flexibility offered is entirely discretionary and should not be regarded as setting a precedent for future sessions.
Repeated late cancellations, frequent requests to reschedule or repeated failure to attend booked sessions may result in the loss of the session and, where appropriate, the refusal of future bookings.
If Elita La Vie needs to cancel or reschedule a coaching session, we will provide as much notice as reasonably possible and offer an alternative appointment at no additional cost.
Confidentiality
We respect your privacy and will treat information shared during individual coaching sessions as confidential.
Information will not be disclosed to third parties without your consent unless we are required to do so by law, or where we believe there is a serious risk of harm to you or another person.
Where coaching takes place in a group setting, all participants are expected to respect the confidentiality of others and not share personal information discussed within the programme outside of the group.
Whilst Elita La Vie is committed to maintaining confidentiality, we cannot guarantee that other participants will always do so. You should therefore use your own judgement when choosing what personal information to share during group coaching sessions.
Any personal information collected through our Website or Services will be handled in accordance with our Privacy Policy.
Health Disclaimer
Elita La Vie provides coaching, education and personal development services to support wellbeing, behaviour change and personal growth.
The information, guidance and resources provided through our website, courses, coaching sessions, workshops, digital products and other services are for educational and informational purposes only. They are not intended to diagnose, treat, cure or prevent any medical, psychological or psychiatric condition and should not be relied upon as medical advice.
Whilst our services may include topics such as sleep, nutrition, movement, habits, stress management and general wellbeing, they are not a substitute for advice, diagnosis or treatment from a qualified healthcare professional.
You should consult your GP or another appropriately qualified healthcare professional before making significant changes to your diet, exercise routine or lifestyle, particularly if you have an existing medical condition, are pregnant, are taking medication or have any concerns about your physical or mental health.
If you are experiencing a medical emergency or a mental health crisis, you should seek immediate assistance from the appropriate emergency or healthcare services.
By using our website or services, you acknowledge that you are responsible for your own health, wellbeing and decisions, and that you participate in our programmes and coaching voluntarily and at your own discretion.
Force Majeure
Elita La Vie will not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay results from circumstances beyond our reasonable control.
These circumstances may include, but are not limited to, illness, injury, bereavement, severe weather, natural disasters, fire, flood, pandemic, government action, industrial disputes, internet or telecommunications failures, power outages, failure of third-party software or platforms, or any other event beyond our reasonable control.
Where such circumstances arise, we will make reasonable efforts to notify affected clients as soon as practicable and, where appropriate, rearrange coaching sessions, workshops or other services at a mutually convenient time.
Nothing in this clause affects your statutory rights under applicable consumer protection law.
Consumer Protection Law
Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited under applicable law.
To the fullest extent permitted by law, Elita La Vie, Charlene Gibberd and any employees, contractors or affiliates shall not be liable for any indirect, incidental, consequential or special loss or damage arising from your use of, or inability to use, our Website or Services.
Our Website, coaching, courses, digital resources and other Services are provided for educational and personal development purposes. Whilst we make every reasonable effort to provide accurate information and high-quality services, we do not guarantee any particular outcome, result or level of success.
You acknowledge that you remain responsible for your own decisions, actions and implementation of any information, guidance or coaching provided through our Services.
Where our liability cannot be excluded, our liability shall be limited to the amount you paid for the relevant Service giving rise to the claim, except where a greater liability is required by law.

Except where prohibited by law, by using our website & services you indemnify and hold harmless Elita La Vie, Charlene Gibberd, employees, contractors and affiliates, from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our website & services or your violation of these Terms and Conditions.
